4th class poison type debuff cast on non flagged/no CW player

today i got debuffed with (i guess) "death breath" , as i know it has no initial damagae (like 1 magic attack or something) just poison effect ("decreases a target’s hp by 480 continuously for 15 seconds.") how is that possible if i was not flagged and there were no cw? as poison type debuffs decreases hp to 1 , any hit from mob is lethal.

that is ok for pvp at the same lvl but during 2 hours a feoh wizzar was using that skill on me all the time and i cant lvl is that fair?....(im 70)

avaqq use this skill on low lvl chars, all day on many spots (in blazing, woa, toi, sos etc... )...noob...

and another bug on this image: cubics of warlocks take dmg/debuffs to chatoic char, but the warlock not in chaotic state.
